As many of you know we adopted an abandoned kitten earlier in the week. He's 5 to 6 weeks old according to the vet and very healthy. There was one more kitten that we tried to catch but were unable to. Late the other night my husband saw our piece of garbage neighbor kick the poor little thing across their porch and yell at it. The guy's wife and in-laws yelled at him and we thought that was the end of it. Hubby said the guy then went in the direction of the kitten but he had a bag of garbage so he just figured he was taking the garbage out.

So this afternoon kids are outside when they come running into the house screaming and all upset about a kitten. I went outside to see if what they were saying was true and sure enough yes, this tiny little kitten was dead in our swimming pool. We have an above ground pool with 4 ft tall slick walls and the stairs were up. NO way for a kitten to get up there and even if it could we have wedding cake steps in the pool so it would have had no problems getting out. We fished the poor little thing out and hubby says it didn't drown...it had a broken neck :( I can't prove it but that jerk next door broke its neck and threw it in our pool. I just want to cry and I haven't been able to eat much all day the picture of it in my head just keeps making me sick :(
 
Please, do immediate report to local SPCA, and get them to press charges. You had eye-witnesses (you and your man), and the in-laws of that family. Please consider reporting this vile person, and have the dead kitten avail. for inspection(prove broken neck).
Horrific...
That is also harassment of your family, and in disgusting fashion. Maybe cops should hear about this one...
 
Unfortunately, if no one actually saw him do so, there is no proof that the neighbor did kill the kitten. :(

The poor little innocent creature...my heart just cries for him. Give your little kitty an extra hug from me, nermal...

You never know, guys. A lot of hard evidence can appear from what appears to be circumstantial. I think you should let the investigators figure it out, and they can determine what happened...
Y'know, if it walks like a duck and quacks like a duck... maybe they might see it too?
 
The sad truth is I don't think the Police or SPCA will be able to do anything. The reason is because even if they do agree the kitten's neck was broken by a human, they won't be able to prove who did it. Especially since no one saw him kill the kitten. You may be able to get him for kicking the kitten... I'm not to positive. You could try reporting him for that and just see what happens. Poor kitten. :(
 
I would certainly have a necropsy done. If the kitten didn't have water in it's lungs, then it didn't die from drowning. However, I do know of a number of pet deaths in family pools. The muscles in the body become very soft and flaccid shortly after death (before rigor mortis sets in), so "floppy head" doesn't necessarily indicate a broken neck.

I'm very sorry you and your family have suffered from such a tragic and traumatic event.

Even if this can't be proven, at least if it is investigated, it sets the basis for any future cruelties your neighbour might inflict. If it is investigated, it is noted in the files somewhere...
Maybe nothing can be done this time, but it sets the groundwork for the next time...
 
That is just so sick. You really need to call the SPCA and I hope you have or are going too.


 
They won't do anything. We have no proof. But you can guarantee my animals are NOT going to be out there unsupervised. As my husband said to the guy's mother in law. If he's capable of this with an animal what's he capable of with your 7y/o grand-daughter. She got really pale over that one. Just pray my house sells quickly so I can get out of here and away from this.
 
I would still call the ASPCA, or the police non-emergency number. They may be able to make him confess to hurting the cat, and since your husband saw him kick it, that's proof of cruelty. Also, he would be on file at the ASPCA as possibly committing animal abuse, so they would not adopt to him. You may be surprised that many animal shelters/humane societies will do background checks on potential adopters and maintain files/information on people they don't want to adopt to. That's why they often require a driver's licence or picture ID to confirm that you really are who you say you are when you adopt, and not someone on their "bad list." Finally, they may come to investigate and find that he has other animals in poor condition. I know you don't want to be a bad neighbor, but this guy is terrible. He also traumatized those kids, which is terrible in itself.

I agree with the above- it could be really important just to have them take note of this, and take the kitten's body if they have a need to necropsy it. It is harassment to you and your family as well if the neighbour did dump the body- you wouldn't be sticking your nose in where you shouldn't be either, your neighbour MADE you involved against your will already.
